K’SerraSerra® Counseling & Wellness LLC (hereinafter referred to as “the Company”) is a limited liability company duly organized and existing under the laws of its state of registration. ‘

The Company operates as a mission-driven organization providing accessible, culturally responsive, and integrative counseling and general wellness support services. These services encompass broadly applicable wellness and supportive activities and are not intended to imply a specialized clinical scope of practice unless explicitly identified, licensed, and authorized in accordance with applicable law.

The Company’s structure is designed to ensure ethical service delivery, operational accountability, and sustainable growth, while upholding its core values of trust, transparency, and inclusive care.

By accessing this website or engaging in services, you expressly acknowledge that you have read, understood, and agree to be bound by the terms of this “Code of Conduct and Professional Standard of Care” agreement.

Client Welfare and Duty of Care

K’SerraSerra® Counseling & Wellness LLC (“the Company”) is dedicated to supporting the well-being, dignity, and safety of all individuals, families, and communities. All community counseling and wellness service providers adhere to applicable professional codes of ethics, including principles aligned with the National Association of Social Workers (NASW) Code of Ethics and relevant state regulations.

Community counseling and wellness providers are expected to prioritize the best interests of those they serve, avoid actions that could cause harm, and exercise sound professional judgment in every interaction. Services should be delivered with respect for each individual’s dignity and worth, while recognizing the importance of human relationships and maintaining professional competence. Providers are also encouraged to honor individual autonomy, embrace cultural and perspective diversity, and acknowledge the value of lived experiences.

The Company and its providers remain committed to fostering a safe and supportive environment. When a client’s needs extend beyond the scope of services offered, appropriate referrals or recommendations for additional care will be made in accordance with ethical and professional standards.

Informed Consent and Client Autonomy

K’SerraSerra® Counseling & Wellness LLC is committed to ensuring that all individuals are able to make informed, voluntary decisions regarding their participation in services. Informed consent is an ongoing process that supports transparency, understanding, and client autonomy.

Prior to engaging in services, individuals are provided with clear information regarding the nature and scope of services, potential risks and benefits, limitations of confidentiality, and any applicable policies or expectations. Individuals are encouraged to ask questions and seek clarification to ensure understanding before and throughout the course of engagement.

Participation in services is voluntary. Clients have the right to decline, modify, or discontinue services at any time, subject to applicable policies and legal or ethical obligations. Clients also have the right to make decisions about their care and to be treated with respect for their values, preferences, and lived experiences.

The Company is committed to protecting client privacy and supporting informed decision-making in accordance with applicable laws and regulations, including those governing confidentiality, privacy, and the protection of personal health information.

Confidentiality and Privacy

K’SerraSerra® Counseling & Wellness LLC is committed to protecting the privacy and confidentiality of all individuals engaged in services. Information shared in the course of services is treated with care and respect and is handled in accordance with applicable laws, ethical standards, and organizational policies governing confidentiality and the protection of personal information.

Confidentiality may be limited under certain circumstances, including when disclosure is required or permitted by law. Such circumstances may include, but are not limited to, situations involving risk of serious harm to oneself or others, suspected abuse or neglect of a child, elder, or vulnerable adult, or compliance with a valid court order or legal requirement.

The Company utilizes reasonable administrative, technical, and physical safeguards to protect personal information, including the use of secure systems for communication and documentation. However, the use of digital platforms involves inherent risks, and absolute confidentiality or security cannot be guaranteed.

Mandated Reporting and Legal Limitations

K’SerraSerra® Counseling & Wellness LLC complies with all applicable laws and regulations regarding mandated reporting and legal responsibilities. Providers may be required to disclose information, without client consent, when such disclosure is necessary to meet legal or ethical obligations.

These obligations may include reporting suspected abuse or neglect of a child, elder, or vulnerable adult, as well as taking appropriate action when there is a credible risk of serious harm to an individual or others. Disclosure may also occur in response to valid legal processes, including court orders or other lawful requirements.

Any disclosure of information will be limited to what is necessary to fulfill the applicable legal or ethical obligation, in accordance with professional standards and governing laws.

Professional Competency and Scope of Limitations

K’SerraSerra® Counseling & Wellness LLC is committed to ensuring that all services are provided by individuals who operate within the scope of their education, training, and professional role. Providers are expected to maintain appropriate levels of competence, engage in ongoing professional development, and adhere to applicable ethical and professional standards.

Services are delivered in accordance with each provider’s qualifications, which may include licensed professionals as well as individuals working toward licensure under appropriate supervision, as permitted by applicable law. Providers do not represent themselves as offering services beyond their level of training, credentials, or authorized scope of practice.

When a client’s needs fall outside the scope of services provided, or require a higher level of care, appropriate referrals or recommendations may be made to ensure continuity and quality of care.

Sexual Misconduct and Anti-Harrassment

K’SerraSerra® Counseling & Wellness LLC maintains a strict zero-tolerance policy for sexual misconduct, harassment, exploitation, or any form of inappropriate or harmful behavior within professional or community interactions.

Sexual misconduct includes, but is not limited to, any sexual contact, advances, or behavior that is unwelcome, exploitative, coercive, or occurs within a professional relationship where there is an imbalance of power. Providers are strictly prohibited from engaging in sexual or romantic relationships with clients or participants in connection with services.

Harassment includes any unwelcome conduct—verbal, non-verbal, or physical—that creates an intimidating, hostile, or offensive environment. This includes, but is not limited to, behavior based on protected characteristics such as race, ethnicity, gender identity or expression, sexual orientation, religion, disability, or other legally protected status.

These standards apply to all individuals engaging with the Company, including providers, staff, participants, and community members. Violations may result in immediate termination of services, removal from programs, and, where applicable, reporting to appropriate authorities or governing bodies.

The Company is committed to maintaining a safe, respectful, and professional environment and will take appropriate action in response to any reported concerns.

Capacity, Guardianship, and Authorized Decision-Making

K’SerraSerra® Counseling & Wellness LLC recognizes that individuals engaging in services may have varying levels of decision-making capacity. The Company does not assess or determine legal competency. When required by law or circumstance, services may involve a legally authorized representative, such as a parent, guardian, or designated decision-maker.

For individuals who are minors or who have a legally appointed guardian or representative, consent for services must be provided by the appropriate authorized individual in accordance with applicable laws and regulations. In such cases, the Company will make reasonable efforts to involve the individual receiving services in a manner that respects their dignity, preferences, and level of understanding.

Clients and representatives are responsible for accurately representing their authority to consent to services. The Company reserves the right to request documentation or verification of such authority where appropriate.

Legal Responsibility and Acknowledgment

Clients are responsible for their own decisions, actions, and outcomes when engaging with services provided by K’SerraSerra® Counseling & Wellness LLC. The Company does not provide legal advice, medical advice, or guarantees of specific outcomes.

Services are provided in accordance with applicable laws, ethical standards, and organizational policies. Engagement in services does not establish any relationship beyond the scope of services explicitly agreed upon.

By engaging with the Company, clients acknowledge their responsibility to use services appropriately and in alignment with the terms, conditions, and limitations outlined in this agreement and related policies.
